Student Threats to teachers and Violence in Schools

Although many educators may feel hard-pressed to define a “threat,” most are confident that they would recognize one when it occurs. Problems often arise, however, when school personnel try to take legal action against students whom they perceive as making threats to harm others. A student who uses what appears to be threatening language simply may be exercising a First Amendment right to express an opinion, a right protected from governmental interference or suppression, even in the school setting. Under the United States legal system, what a reasonable educator might categorize as a threat may or not be a “true threat” under the law.
At a Washington, D.C., political rally in August 1966, an 18-year-old unhappy with his 1-A draft classification declared, “If they ever make me carry a rifle, the first man I want to get in my sights is LBJ,” referring to then-President Lyndon B. Johnson. The young man, Robert Watts, was charged with and convicted of a felony under a federal statute that makes it a crime to “willfully and knowingly” threaten the president. The U.S. Supreme Court reversed his conviction three years later in what became the seminal Court decision distinguishing between threats and “true threats.” Recognizing a “profound national commitment to . . . debate on public issues,” including speech that may be “vehement, caustic, and unpleasantly sharp,” the Court found that the youth's statement was merely “political hyperbole.” Watts, the Court decided, had not uttered a true threat. Unfortunately, the Supreme Court declined to help educators by explaining what would make ordinary threatening-sounding words into a true threat.

Deciding What Constitutes a True Threat

Fast-forward to February 1993. Sarah Lovell, a 15-year-old California high school student, has been trying all day to get her class schedule changed. She has been shuffled back and forth between the assistant principal's and guidance offices. Finally, she thinks her schedule is settled, but when Linda Suokko, her guidance counselor, enters the changes into the master schedule, Suokko sees that the assistant principal has approved Sarah for courses that are already overloaded. Suokko tells the girl that she may not be able to make the changes. Sarah loses her patience and, according to Suokko, says, “If you don't give me this schedule change, I'm going to shoot you.” Although Sarah apologizes immediately and insists that she did not say those exact words, her principal suspends her and files a strongly worded student referral form as part of her permanent record.
When Sarah's parents brought suit to have the referral form removed from her file, the Court of Appeals for the Ninth Circuit upheld the principal's actions, ruling that Sarah's communication to Suokko was a “true threat.” Alleged threats, according to the Ninth Circuit, are judged by an objective standard that focuses on the speaker. The test is whether a reasonable person uttering a communication would foresee that the listener would interpret the statement as a serious expression of intent to harm. True threats, the Ninth Circuit emphasized, are not among the categories of expression protected by the First Amendment. Sarah's principal, therefore, was justified in suspending Sarah and filing the student referral form. In addition to the “objective speaker” test, the Ninth Circuit also requires that statements appearing to be threats “should be considered in light of their entire factual context.” If the words uttered and the surrounding circumstances are so “unequivocal, unconditional, immediate, and specific” that they convey a seriousness of purpose and the prospect of being carried out in the near future, then the statement is a true threat.
Courts in the Ninth Circuit, then, like Sarah Lovell's court, will rule that a putative threatening statement is a true threat if the speaker, as a reasonable person, should have foreseen that the listener would interpret the statement uttered as a threat of bodily harm or assault. The burden is on the speaker to reasonably foresee an unpleasant reaction to what was said, considering all the circumstances. Sarah, as a reasonable person, should have known her statement would upset Suokko. The Ninth Circuit's definition of true threat says nothing about how reasonable the listener must be. Suokko could have completely overreacted to Sarah's words; in fact, she may even have misheard the student. Practically speaking, the Ninth Circuit requires speakers to know in advance their listeners' reactions. Moreover, using the Ninth Circuit's reasonable speaker standard, one wonders whether a frustrated teenager in Sarah's circumstances could ever be considered reasonable.
If Sarah Lovell had expressed her frustration in another state—for example, in Virginia or Maryland, both of which are bound by the standards adopted by the Fourth Circuit Court of Appeals—the standard that the court applied would have been different. Courts in the Fourth Circuit judge whether a communication is a true threat solely by considering the communication's effect on the recipient. Whether or not the speaker had any idea, or even considered, how the listener would react to her allegedly threatening communication is unimportant in complaints litigated in Virginia or Maryland.
This point may not have made a difference in Sarah's case, because Suokko, the listener, also perceived Sarah's words as a threat. Nevertheless, the judicial standards in many states are different and have different implications. Focusing solely on the listener's reaction may negate totally consideration of the speaker's intent in the communication. Focusing solely on what a speaker should have known in advance about the listener's reaction presumes that the speaker was capable of rational thought when she may have been completely consumed by anger or frustration. Deciding whether a communication is a true threat that is actionable under the law, therefore, depends on the analysis adopted by the relevant jurisdiction.

Threats Delivered in Different Forms

In addition to speaker and listener tests, other jurisdictions have adopted hybrid tests or burdened traditional tests with specific requirements (e.g., that the threat be directly communicated to the intended victim). Technology that facilitates communication at a distance complicates the analysis. For example, either party to a telephone conversation may misperceive communications, because the speaker and listener can only hear each other but not distinguish visual cues. Similarly, nonverbal modes of communication, like works of art, confound traditional true threat analyses. Poetry may do the same.

American economy faces ‘considerable uncertainty’

Federal Reserve Chair Janet Yellen warned Tuesday that the US economy faces “considerable uncertainty” from slower domestic activity and from a possible British vote to break with the European Union.
Pointing to dragging hiring and business investment recently, and to the risk that a pro-Brexit vote will send shock waves through global markets, Yellen signalled that the Fed has become less optimistic about US growth over the short term and will proceed with great caution on plans to raise interest rates.
She said in testimony to the Senate Banking Committee that US growth has picked up noticeably in the second quarter from the sluggish pace at the beginning of the year. Nevertheless, she said economic growth has been uneven and clear downside risks remain a threat.
“Considerable uncertainty about the economic outlook remains,” she said.
“The latest readings on the labour market and the weak pace of investment illustrate one downside risk — that domestic demand might falter.” Added to that, Yellen said, are the challenges of slower growth and reform hurdles in China, and the referendum in Britain on Thursday on pulling out of the European Union, which could radically alter Europe’s economic framework.
“A UK vote to exit the European Union could have significant economic repercussions,” she told the panel. It could rupture what she called “a very important relationship “between Britain and the European continent, and could have an impact on the progress of European integration.
“It would usher in a period of uncertainty that is very hard to predict,” she added, warning of volatility in global markets.
Yellen was speaking days after the Fed’s policy body, the Federal Open Market Committee, turned more dovish in its view of the economy as it again kept its benchmark interest rate locked at an ultra low level on Wednesday.
While Yellen reiterated the FOMC’s expectations that it could increase the federal funds rate twice before the end of the year, ending 2016 close to 1.0 per cent, she also highlighted risks to the longer term.
She noted that a number of prominent economists have argued that slow productivity growth in the United States will continue in the future, dampening overall growth.
“We cannot rule out” that possibility, she said.
And she said that as long as other domestic weaknesses persist, like slow household formation and business investment, and if global risks remain significant, then the Fed needs to hold interest rates ultra-low “to keep the economy operating near its potential.” Yellen was speaking in semi-annual testimony to Congress on the state of the US economy and Federal Reserve monetary policy.
Despite her concerns over the short-term outlook, Yellen reiterated that she and the FOMC were fairly confident in the medium-term outlook that growth will remain moderate, that companies will continue to hire workers at a steady pace and that inflation, which has been overly weak, will turn upward.
Even if Britain does move to break with the European Union, she rejected predictions that the US faces a possible recession this year. “I don’t think that’s the most likely case, but we just don’t know what will happen” after the Brexit vote, she said. “I remain quite optimistic.”
US markets showed little reaction to the Fed chair’s testimony. Near midday, Wall Street was trading close to break-even for the day, with the S&P 500 up 0.1pc. The dollar edged up slightly to $1.1256 against the euro and 104.56 yen.

English court rejects Indian attempt to strike out Pakistan’s claim to Hyderabad Fund

SLAMABAD: The British High Court of Justice on Tuesday rejected India’s attempt to strike out Pakistan’s claim to the Hyderabad Fund in a judgment the Foreign Office said is a “clear vindication of Pakistan’s stance”.
“The Seventy Five (75 page) judgment of Henderson J. is a clear vindication of Pakistan’s principled stance, and the effective legal strategy being pursued by the new legal team,” Foreign Office Spokesperson Nafees Zakaria said in a statement.
India failed to persuade the court that Pakistan’s position was untenable and it could show no legal entitlement to the 35 million GBP sitting in a bank account in the name of the High Commissioner of Pakistan, since 20th September 1948, the FO statement added.
The judge accepted that there was good evidence in support of Pakistan’s claim to the monies, which needed to be fully considered at a trial and accepted that there were good legal arguments which were supportive of Pakistan’s position, it added.
India, which would now face a substantial costs claim after losing its applications, had argued that Pakistan’s claim to the monies was not valid.
After hearing the arguments put forward by Pakistan’s legal team, the judge considered the evidence that “India and Princes could not assert that Pakistan’s claim to the monies was without basis”.
According to The Times of India (TOI), the Hyderabad Fund was a transfer of GBP 1,007,940 and 9 shillings to a London bank account in the name of Pakistan’s first High Commissioner to the United Kingdom, Habib Ibrahim Rahimtoola, at the Westminster Bank in 1948.
The money was transferred to Rahimtoola by an agent who was acting on behalf of the seventh Nizam of Hyderabad, the TOI reported.
When India and Pakistan were being formed as sovereign states in 1947, there were several princely states too, which were given a choice by the United Kingdom to join either of the two new states or remain independent.
Nizam had decided to remain independent but Hyderabad was annexed to India on September 18, 1948.
On September 20, 1948, the money was transferred to Rahimtoola, and seven days later on September 27, Nizam “sought to reverse the transfer claiming that it had been made without his authority”.
The Foreign Office, in its statement, said the events in 1947-48 were very tense.
“The State of Hyderabad was in danger of being attacked and taken over by India. The UK government archive documents record growing concern voiced by British government officials at the conduct of India towards the State of Hyderabad and its people,” it said.
India maintained its argument before the court that as Nizam had asked for the return of the monies within days of its transfer to Pakistan, he must not have consented to it being handed over to Pakistan.
However, the judge observed that Nizam might not be acting on his free will after his state was annexed to India, the Foreign Office statement said.
The case would now proceed to trial, unless settled.

That was intense for me, on the grounds that in the event that I was lifting, I'd need to lift the same 120kg person 10 times for 10 diverse edges. What's more, moreover, get tossed that multiple occassions on the ground. This demonstration is not rehashed that multiple occassions in genuine battles in the ring."

"When I used to leave the ring, after the shoot, I used to feel like an assaulted lady. I couldn't walk straight. I would eat and after that, head right back to preparing. That couldn't stop," he said.

Seconds after the fact he withdrew his announcement and said, "I don't think I ought to have.... It feels like the most troublesome... I couldn't make strides. I couldn't make strides."

However, the harm had been finished. The "assault" remark was soon grabbed and made a media hullabaloo.

NDTV reported that NCW Chief Lalitha Kumaramangalam has requested a statement of regret from the whiz. "Considering the quantity of female fans he has, he ought to have put forth such an expression. Salman Khan ought to apologize. It is very dishonorable that such an open figure can talk so flippantly," she said.

She wasn't the special case who was insulted by his announcement, BJP pioneer Shaina NC additionally emphatically scrutinized the performing artist. "Salman must be denounced for his announcement. The Salman everybody knows regards ladies and on the off chance that he respects ladies then he ought to concede he committed an error and apologize," she said.

Secretary of the All India Progressive Women's Association (AIPWA) Kavita Krishnan took the issue on a bigger scale. "Salman Khan's remark trivializes assault, however it's not simply Salman, assault analogies are regular in the public arena and movies."

As per India.com, Salman's dad Salim Khan took to Twitter to dispel any confusion air about his child's announcement and apologized for his benefit.

Side effects of osteoporosis medicine

If you were diagnosed with osteoporosis, chances are you got a litany of reasons why you should take drugs to treat this “disease.” Most likely, your doctor also mentioned all sorts of horrible things that could happen to you if you don’t take the drugs.
What’s interesting is that most doctors won’t tell you anything about their harmful side effects. They leave that up to the consumer – you – even though the doctors are supposed to be the experts!
But since you’re here and reading this, you are one of the consumers who is an expert – an expert on your own bone health.
So to counter some of the scare tactics and drug-pushing mantras of the Medical Establishment, today I am bringing you the top 5 reasons never to take osteoporosis drugs.

Reason #1: Drugs Are Synthetic Chemicals That Work Against the Body

There is a misconception that drugs heal the body. They don’t. Drugs can only temporarily mask symptoms – and not always. What’s more, they artificially mimic healing by counteracting the body’s processes. I’ll explain…
Osteoporosis drugs “work” by stopping bone remodeling, which is the body’s finely-balanced process for renewing bone. This process goes on continually, with crucial vitamins, minerals, enzymes, proteins, and various other substances all coming into play. Osteoclasts (bone-removing cells) and osteoblasts (bone-building cells) work together to tear down and replenish your skeleton.

Bone Loss is Only Half of the Remodeling Equation

That’s right – you have to lose bone to build new bone. Like any building project, demolition is necessary to remove old structures before building. Imagine what a mess the average city and neighborhood would be in, if we simply tried to build on top of old structures. It would be unstable and unsightly.
When bone cells wear out, they need to be removed. Osteoclasts do this, and then osteoblasts put new bone cells in their place. Thus, your bones are always being rejuvenated, and they are able to stay strong and flexible.
Osteoporosis drugs stop the entire process, not allowing old bone cells to be shed, so bones become thick and brittle, composed almost entirely of worn-out cells. Yes, the bone may appear denser, but the bone’s tensile strength is greatly compromised, ironically, making bones more prone to fracture. This is what happens when synthetic chemicals work against the body.
And this is precisely why…

Reason #2: All Osteoporosis Drugs Have Bad Side Effects

You may be wondering which osteoporosis drug is safe, and whether or not a particular drug has side effects. Unfortunately, a safe drug without side effects simply doesn’t exist.
All osteoporosis drugs, regardless of which company manufacturers it, have bad side effects.

What’s So Bad About Them?

All osteoporosis drugs can induce life-changing side effects. Many of the side effects and the resulting conditions are irreversible. Let’s take a look at some of the most significant ones.
  • Osteonecrosis of the jaw (ONJ) is a terrible, difficult-to-treat, and potentially disfiguring side effect of bisphosphonates. This disease was first noted back when match factory workers, who handled white phosphorous daily, developed the tell-tale symptoms of ONJ, called “phossy jaw” back then: jaw pain, infection, abscesses, and rotting jaw bone. Bisphosphonates, being phosphorous-based, have a similar effect.
The Medical Establishment’s response was to put black box warnings about ONJ on all bisphosphonates. The sad reality is that most people who raise concerns about such warnings will have their fears brushed off by their doctor.
  • Atrial fibrillation (fast, irregular heartbeat) is associated with bisphosphonates, a side effect confirmed by recent research. Just this month, scientists at the Maimonides Medical Center in New York published a meta-analysis showing that bisphosphonate use increases the risk of serious atrial fibrillation by 40%.1 “Evidence from RCTs and observational studies suggests a significantly increased risk of AF requiring hospitalization,”1 researchers conclude.
  • Esophageal cancer risk is greatly increased with the use of bisphosphonates, especially Fosamax. According to an analysis of the FDA’s database (the adverse event reporting system, or AERS), nearly 75% of bisphosphonate-caused esophageal cancer were directly attributed to Fosamax use.2 Alarmed by what they found, the researchers concluded that “Increased awareness and vigilance is needed for patients receiving oral bisphosphonate therapy.”
“Increased awareness” and shunning these dangerous drugs is exactly what the Save Our Bones Program – and this website – are all about!

Sadly, This is the Most Ridiculous and Ironic Side Effect

Perhaps the most ironic (and ridiculous) side effect of osteoporosis drugs is increased fracture risk.3
The ostensible reason behind taking drugs for low bone density is to decrease the chances that one of your bones will break. That’s what makes this side effect so ironic!
Atypical femoral fractures are the most common break associated with osteoporosis drugs, and especially bisphosphonates. These are referred to as “atypical femoral fractures” because they are just that – not typical.
The femur is the strongest bone in the body. Under normal conditions, it doesn’t simply snap. But when it’s been made brittle and hard by drugs, it can break near the head of the femur when you’re doing simple, everyday things.
Of course, this doesn’t mean that the drug has been pulled from the market, or won’t be prescribed anymore. Instead, the Medical Establishment thinks their tracks are covered if they simply put a warning on all bisphosphonates, like they did for ONJ.

Remember, These Are Just the Biggies…

The list of annoying and even debilitating side effects also includes nausea, flatulence, blurred vision, joint pain, muscle pain, and abdominal cramping. They may not sound that bad in print, but if you’ve tried to live with one or several of these effects, you know how devastating they can be.

Reason #3: Quite Often, Osteoporosis Drugs Don’t Work

I actually hesitate to use to term “work” when describing any osteoporosis drug, which is why I often put it in quotes. If the drug is supposed to improve bone health, then it doesn’t work at all; it fails miserably. And even if it “works” according to medical protocol – that is, it effectively increases bone density scores in some people – there is still a high price to pay, as discussed in Reason #2 above.
We also talked about how osteoporosis drugs, in a pharmaceutical sleight of hand, can appear to increase bone density by halting healthy remodeling.
Many in the Save Our Bones community have posted that they’ve been taking osteoporosis drugs for many years to no avail. In fact, many have had to go to the emergency room because of the effects of these drugs.

Why take the chance? The price of osteoporosis drugs is just too high!

With the Save Our Bones Program, you can achieve significant results without taking chances with your health, body, and well-being. Many have done so, and I invite you to read their stories here.

Reason #4: Drug “Approvals” are Meaningless

A drug has to be “approved” by the FDA before it can be put on the market. Have you ever wondered why such dangerous drugs get approved, especially when they have side effects worse than the condition they are intended to treat?
Take, for example, the osteoporosis drug Forteo. This drug is a synthetic form of parathyroid hormone, which, oddly, is known to break down bone in conditions like hyperparathyroidism. Yet mysteriously, the Forteo injection causes abnormally rapid growth of bone cells, resulting in a very frightening side effect: osteosarcoma, a form of bone cancer.
Despite the fact that how Forteo “works” was a complete mystery, and despite this potentially fatal side effect, Forteo was approved by the FDA.
Another seemingly “natural” drug not only may cause cancer; it’s also entirely useless in increasing bone density.
I am referring to calcitonin or calcitonin salmon, the fish-based nasal spray, pill, or injection that doesn’t even “work,” and may actually cause cancer in those taking the drug in pill form.4

How Does This Make Any Sense?

The FDA was put in place to monitor drug safety with the public interest at heart. Unfortunately, the reality is much less philanthropic than we’ve been led to believe.
The FDA has forged a disturbing connection with Big Pharma that means two things: more money for them, and harm to your health.
You see, Big Pharma pays “user fees” to the FDA as part of the Prescription Drug User Fee Act of 1992. The intention of these fees was ostensibly to speed up the drug approval process so the United States could keep up with the rest of the world. Not surprisingly, in this game of “catch up”, the only winner is Big Pharma.
In addition, executives with the FDA and Big Pharma are caught in a revolving door as they work for one and then the other. For example, FDA executive Keith Webber left the regulatory agency to work for drug company Perrigo. And on the flip side, Dr. Lawrence Yu, an executive for 8 years at the pharmaceutical companies Pfizer (Upjohn) and GlaxoWellcome, left and joined the FDA. These are just two examples of many.

The Latest FDA Scandal

A recent public records request led to the revelation of hundreds of e-mails between the FDA and various pharmaceutical companies. They also revealed something about how the drug approval process works…and how corrupt it really is.
When a drug is up for approval, the FDA holds a panel, in which clinical trial evidence is discussed. In this most recent scandal, painkillers were the topic of discussion, and much of the discussion took place not before the panel, but behind closed doors.
You see, a select few individuals on the FDA panel’s steering committee met in private with Big Pharma employees to draft documents that would lead to approval. They were effectively bypassing the panel votes.
How did the FDA decide which drug company’s employees got to attend the secret meetings? They chose those who paid, of course – as much as $25,000 to attend one meeting. Shameful!
The question of approval for osteoporosis drugs could be answered easily if only Reason #5 were understood.

Reason #5: Osteoporosis, as Stated in the Save Our Bones Program, is Not a Disease

“…you don’t have a disease and therefore, it is not ‘your’ osteoporosis or ‘your’ bone disease. Your bone loss is a direct reflection of your biochemistry.”
These words are found in Chapter 1 of the Save Our Bones Program. It refers to the true cause of osteoporosis: an imbalance in the body’s chemistry. Therefore, achieving biochemical balance is the core of the osteoporosis solution. And no drug can do that – only you, by taking your bone health into your hands and with the necessary knowledge, can achieve an ideal state of acidity/alkalinity that your bones need to thrive.
The Save Our Bones Program, with its comprehensive yet easy nutritional and lifestyle guidelines, is designed to help you achieve that balance and reverse osteoporosis or osteopenia once and for all.
